These Moolah Points Messaging Terms & Conditions (“Messaging Terms”) govern promotional SMS and MMS messaging programs offered through Moolah Points. 

Moolah Points is operated by Vitreous Alliance INC (“Moolah,” “Moolah Points,” “we,” “us,” or “our”).

These Messaging Terms should be read together with our Moolah Points Terms & Conditions and Moolah Points Privacy Policy

These Messaging Terms apply when you separately choose to enroll in an SMS or MMS messaging program.

Accepting the general Moolah Points Terms & Conditions, creating a Moolah account, verifying your telephone number, subscribing to a Participating Merchant’s loyalty program, making a purchase, or otherwise using Moolah does not by itself constitute consent to receive promotional SMS or MMS messages. 

1. Moolah Messaging Programs 

Moolah Points enables customers to participate in optional promotional SMS and MMS messaging programs offered by Moolah or by Participating Merchants using the Moolah platform.
Depending on the messaging program for which you separately opt in, messages may include information relating to rewards, discounts, coupons, bonus-point opportunities, loyalty campaigns, merchant promotions, product offers, limited-time offers, campaign reminders, new promotions, and other loyalty or promotional content associated with the identified messaging program.
The Moolah Points or Participating Merchant name associated with the messaging program should be identified when you opt in.
Consent to receive messages from one Participating Merchant or messaging program does not automatically constitute consent to receive promotional messages from another unrelated Participating Merchant or messaging program.

2. How Customers May Opt In 

Moolah may provide different methods for customers to voluntarily enroll in promotional messaging programs.
Depending on the available Moolah experience, customers may be given the opportunity to opt in through the Moolah mobile application, a Participating Merchant’s Moolah standalone device or kiosk, a Moolah web enrollment page, a QR-code registration flow, or another authorized opt-in method.
Promotional SMS or MMS consent is voluntary and separate from acceptance of the Moolah Points Terms & Conditions and acknowledgment of the Moolah Points Privacy Policy.
Promotional messaging consent is not required merely to create a Moolah account, participate in ordinary loyalty functionality, earn eligible points, redeem eligible points, transfer eligible points, or make a purchase.
Where an optional checkbox or toggle is used to collect promotional messaging consent, it should not be selected or enabled by default.

3. Consent to Receive Messages 

When you separately opt in to an identified Moolah Points or Participating Merchant messaging program, you authorize the applicable identified sender to send recurring promotional SMS or MMS messages to the mobile telephone number you provided.
Messages may be sent using automated technology where permitted by applicable law.
Your consent applies to the specific messaging program or sender identified when you opt in and does not automatically authorize unrelated merchants, programs, or message types.
Consent to receive promotional messages is not a condition of purchase.
You are responsible for providing a valid mobile telephone number that belongs to you or that you are legally authorized to use.

4. Message Frequency 

Message frequency varies.
The number and frequency of promotional messages you receive may depend on the Participating Merchant, messaging program, available campaigns, loyalty activity, communication preferences, and other program-related activity.
Some messaging programs may send recurring messages.

5. Message and Data Rates 

Message and data rates may apply.
Your mobile carrier may charge you for sending or receiving SMS or MMS messages according to your wireless service plan.
Moolah Points does not control charges imposed by your mobile carrier.

6. How to Opt Out 

You may withdraw your consent to receive promotional SMS or MMS messages from an applicable messaging program at any time.
To stop receiving promotional messages, reply:

STOP 
to an applicable promotional message.
After a valid opt-out request, you may receive a final confirmation message confirming that you have been unsubscribed.
Once your opt-out request has been processed, you will no longer receive promotional SMS or MMS messages from the applicable messaging program unless you subsequently provide valid consent again.
You may also use another unsubscribe or communication-preference method made available by Moolah or the applicable Participating Merchant.
Opting out of promotional SMS or MMS does not automatically close your Moolah Points account or unsubscribe you from a Participating Merchant’s loyalty program. You may continue to use ordinary Moolah loyalty functionality subject to the Moolah Points Terms & Conditions.

If the message relates to a Participating Merchant’s specific promotion, campaign, reward, coupon, or loyalty program, you may be directed to the applicable Participating Merchant for assistance.

8. Transactional and Service Messages 

Promotional SMS and MMS messages are different from transactional or service-related communications.
Moolah may use SMS or another available communication channel for communications reasonably necessary to provide functionality requested by you, such as OTP verification, account verification, security notifications, account-related information, point-transfer information, or customer-support communications, where permitted by applicable law.
Opting out of promotional messaging does not by itself close your Moolah Points account or prevent you from using other available Moolah Services.
The availability of transactional or service-related communications after a promotional SMS opt-out may depend on applicable law, carrier requirements, messaging-provider requirements, and the technical configuration of the applicable messaging service.

9. Participating Merchant Messaging 

Participating Merchants may use Moolah technology to communicate with customers who have provided the required permission for the applicable messaging program.
Enrollment with one Participating Merchant does not authorize promotional SMS or MMS from an unrelated Participating Merchant.
Likewise, earning points, redeeming rewards, making a purchase, providing a telephone number, completing OTP verification, or joining a merchant’s ordinary loyalty program does not by itself constitute consent to receive promotional messages.
Where a Participating Merchant-specific messaging program is offered, the applicable merchant or messaging program should be identified as part of the opt-in process.

10. Privacy and Mobile Information 

Moolah handles mobile telephone numbers, messaging preferences, opt-in information, and consent records in accordance with the Moolah Points Privacy Policy.
Mobile information, including mobile telephone numbers, SMS/MMS opt-in information, and messaging consent, will not be shared with third parties or affiliates for their own marketing or promotional purposes.
Moolah does not sell, rent, purchase, or transfer SMS/MMS opt-in consent for unrelated marketing purposes.
Where you expressly opt in to an identified Participating Merchant’s messaging program, Moolah may process the information necessary to administer that specific program.
Moolah may use telecommunications providers and other service providers acting on our behalf where reasonably necessary to deliver messages, maintain communication preferences, provide customer support, prevent fraud, maintain security, or operate the messaging service.
Those service providers are not authorized by Moolah to use your mobile telephone number or messaging consent for their own marketing or promotional purposes.
Consent provided for one messaging program is not transferred or interpreted as consent for unrelated Participating Merchants or unrelated promotional messaging programs.

11. Carriers and Message Delivery 

Wireless carriers and messaging networks are outside Moolah’s control.
Carriers are not liable for delayed or undelivered messages.
Message delivery may depend on your mobile carrier, mobile device, network availability, geographic location, telecommunications infrastructure, and other circumstances outside Moolah’s reasonable control.
Moolah does not guarantee that every message will be delivered or delivered within a particular period.

12. Mobile Numbers and Devices 

You must provide a mobile telephone number capable of receiving SMS or MMS messages where applicable.
If you change, transfer, deactivate, or stop using a telephone number associated with your Moolah account or messaging preferences, you should update your account information as soon as reasonably possible.
You should not enroll a telephone number belonging to another person unless you are legally authorized to use that number.

13. Communication Preferences

Where available, Moolah may allow you to manage communication preferences separately for SMS/MMS, email, and push notifications.
Changing your SMS or MMS preference does not automatically change your email or push-notification preferences. Likewise, changing another communication channel does not automatically change your SMS or MMS preference.
Each communication channel may be subject to its own consent requirements and applicable law.

14. Changes to Messaging Programs 

Moolah or an applicable Participating Merchant may modify, suspend, or discontinue a messaging program where permitted by applicable law.
Moolah may also update these Messaging Terms from time to time. The Last Updated date at the beginning of these Messaging Terms identifies the most recent version.
Where required by applicable law, appropriate notice of material changes will be provided.
Changes to these Messaging Terms do not, by themselves, create new promotional messaging consent where separate consent is required.

15. Relationship to Other Moolah Terms 

These Messaging Terms apply specifically to promotional SMS and MMS messaging programs.
The Moolah Points Terms & Conditions govern your general use of the Moolah Points loyalty and rewards Services, while the Moolah Points Privacy Policy explains how personal information, including communication and consent information, is collected, used, disclosed, retained, and protected.
If there is a conflict between these Messaging Terms and the general Moolah Points Terms & Conditions concerning an SMS or MMS messaging program, these Messaging Terms will apply to that messaging issue to the extent permitted by applicable law.
Email marketing and push notifications are not governed by these Messaging Terms unless expressly stated otherwise. They remain subject to applicable communication preferences, the Moolah Points Terms & Conditions, the Moolah Points Privacy Policy, and applicable law.

16. Applicable Law and Consumer Rights 

These Messaging Terms are governed by the laws applicable under the Moolah Points Terms & Conditions, except where mandatory applicable law requires otherwise.
Nothing in these Messaging Terms is intended to exclude, restrict, or waive any consumer, privacy, communications, or other legal right that cannot lawfully be excluded or waived.
Where mandatory applicable law imposes additional consent, identification, unsubscribe, privacy, or messaging requirements, those requirements will apply.
